OVERVIEW AND GENERAL USE OF THIS WEBSITE

This website is operated by Berkano Foods Ltd. All services provided on this website, including information, is available to you, the customer/user under the following terms and conditions.
By using our website, you are agreeing to all the following terms and conditions outlined.

THE RULES FOR ORDERING FROM US
1. ORDERS WITHIN CANTERBURY REGION
You can choose any one, or a combination of our services offered to meet your needs.
If you choose to use our services you will need to make an account with us which will save your details every time you wish to order.
We are not a subscription based website, so cancelling or suspending any orders are not permitted.
The cut-off times for next day delivery is midday the day prior, or next day delivery is not guaranteed.
If you placed your order before midnight Sunday, your order will be delivered the next day (Monday)
Orders that are placed on Sunday, Monday, Tuesday, Wednesday and Thursday will be picked and sent the following day. If you place an order on Friday or Saturday, your order will be sent off the following week (Monday)
Delivery days may change due to unexpected circumstances.

If you are outside of Christchurch, Waimakariri, Selwyn, Darfield then your order may be put on an overnight service with New Zealand Couriers and will not be delivered same day.
*We cannot guarantee a same day delivery. This is because we use a courier company (NZ couriers) and they cannot guarantee same day delivery.
We will try our best to get all our ingredients to prepare meals each week, however if we are not able to source the ingredients from our supplier, or they are out of season, we will substitute them with something else for your convenience.
Because we have a short time-frame for our orders to be processed and the fact we are not subscription based, once we have received an order we must process it as orders are sent out the next working day.
You cannot choose to suspend an order or cancel indefinitely.
There is a minimum order of $50.00 to be spent before an order is processed.
Deliveries are made on week days (Monday, Tuesday) between 8:00 a.m. and 6:00 p.m.
Public holidays will affect these delivery times and days.
If something out of the ordinary arises due to our courier service, we will notify you on your products arrival date.

For next day delivery, all order must be placed before midnight the night prior. 
Orders that were placed between these times will be directed to the next delivery day.

2. WE RESERVE THE RIGHT TO:
Refuse an account made of potential customers for any reason;
Refuse service to anyone for any reason at any time.
Cancel orders to anyone for any reason at any time.
Decide if an order placed through our website is accepted or fulfilled;
Modify or discontinue any services offered

3. CUSTOMER LIABILITY AND GENERAL CONDITIONS
All orders made under your login are assumed to be made by you (the customer) and you are held liable.
You agree to not copy, sell, resell, reproduce, duplicate or exploit any of the Services offered on this website.

PAYMENTS
4. OUR PRICES
Our prices for every meal is available on our website.
Prices are exclusive of GST.
All deliveries are charged depending on which area you are in. If the delivery address is rural, the customer will be charged an additional cost depending on where they are located.
All prices are in New Zealand Dollars.
Berkano Foods reserves the right to change prices of all its meals during the term of this agreement. You will be notified of any price change via looking at the website.
5. PAYMENT AND INVOICES
All invoices will be provided via email on a weekly basis.
Payment is debited when you order.
Payment methods for online orders include: internet banking, credit card, debit card and PayPal. For all other forms of payment please contact Berkano prior to placing an order through our website.
If credit card payments are declined we will automatically decline your order. Contact will be made immediately via email and we will request an alternate payment, to achieve your requested delivery.

PRODUCT AVAILABILITY
6. PRODUCT AVAILABILITY
We will make every effort to fulfill orders placed through this website, although we are not liable to any person if we are unable to, or decline to supply a meal plan or product for any reason.
We may delay dispatch or delivery of an item due to availability, we will always try our best to notify you of any delay.

DELIVERY
7. OUR DELIVERY ZONES FOR DINNER MEALS
We deliver New Zealand wide. Please see our map to view our zone to see if you are within our delivery area. If you have any uncertainty to whether your house is within our delivery zone please contact us prior to placing an order through our website.
8. LIABILITY
Deliveries will, subject to these terms and conditions, be made to the customer supplied delivery address on the delivery date (Monday).
We are entitled to commission third party distributors to make our deliveries.
Due to unforeseen circumstances, we may be required to deliver outside of our advertised delivery times, if this occurs you will be notified of any delays as soon as possible.
Once your order has been delivered to your house Berkano Foods Ltd is not responsible if the order is stolen or if the order is spoiled due to being left out for more then 8 hours.
9. CHANGE OF DELIVERY ADDRESS
Your address, along with other personal details, can be changed in Your Account section. If you need to change your delivery address after a payment has been processed you can notify us up to 24 hrs prior to delivery the following Monday.

OWNERSHIP AND RISKS
11. RISK ASSOCIATED WITH PRODUCT PASSED ON DELIVERY
Ownership, responsibility and risk in the Products shall pass to the Customer on delivery to the delivery address.

WARRANTIES
12. WARRANTIES
All representations, terms, warranties, guarantees, or conditions whether implied by statute, common law or custom of the trade or otherwise, including, but not limited to, implied warranties, guarantees or conditions are excluded fully permitted by law. You acknowledge that you do not rely on any representation or statement made by or on behalf of any member of Berkano other than the express provisions of these terms and conditions. You must ensure that the Products are not used for any purpose for which they are not suitable and you are responsible for using all necessary skill and care in handling and using the Products. You expressly acknowledge and agree that Berkano does not assume any obligation or liability for any advice given, and that all such Products are accepted by you entirely at your risk.

12.1 REFUNDS/STORE CREDITS

Berkano Refund Policy 
When placing an order please make sure it's correct before you checkout. Please contact us immediately if a mistake has been made. We do not give refunds if you simply change your mind or make a wrong decision.

You will only be given a refund or exchange if your meal order is wrong and/or different to what you purchased online. 
We are not responsible for damages made to your order during the delivery stage. Delivery time may vary dew to courier schedule. If you have any issues Please contact us immediately at hello@berkano.co.nz

If damages occur to your order you must contact us within 24 hours of receiving your order. Once we had been notified we will investigate what has happened, and who is liable. If the courier company is found liable, we will seek compensation directly from them and you are eligible for a store credit with us. 

Berkano Foods reserves the right to refuse a refund for any damaged product.

Berkano Foods reserves the right to refuse a refund if there is a condition out side fo the companies control and/or caused by another company and not Berkano Foods.


LIABILITY AND INDEMNITY
13. ALLERGIES
Except where we specifically and expressly advise you otherwise (e.g., gluten free), the Boxes are not designed to cater for allergies or specific or cultural dietary requirements. Some of our meals can be made gluten free while others cannot. This means to the best of our knowledge everything we have supplied in the boxes is gluten free but we do not have the same guarantee from our suppliers. We cannot guarantee that some products from our suppliers has not been processed in a facility that does not contain gluten. You are responsible for checking that the ingredients in the boxes are gluten free.

14. INDEMNITY
Notwithstanding any other term, you agree to indemnify Berkano against all liabilities, losses, claims and expenses suffered or incurred by you, and all claims and demands made against Berkano, arising directly or indirectly out of your use of the Website, in breach of these terms and conditions and/or the failure to deliver any products.

GOVERNING LAW
15. GOVERNED BY NEW ZEALAND LAW
New Zealand law governs the use of this Website and the terms and conditions.
